9 How and Where Do You Store or Transfer My Personal Data
Our online store is hosted by Shopify. The Shopify administration currently identifies the European Union as Our customer-data hosting location. This does not mean that all processing takes place exclusively in the EU or the UK. Shopify, its affiliates and service providers may process data in other countries, including Canada and the United States.
Where We transfer personal data outside the UK, We use the safeguards required by the Data Protection Legislation. Depending on the destination and recipient, these may include UK adequacy regulations or approved contractual safeguards, such as the UK Addendum to the EU Standard Contractual Clauses.
Shopify’s processing and transfer arrangements are described in its Data Processing Addendum at https://www.shopify.com/legal/dpa. Information about its subprocessors is available at https://help.shopify.com/en/manual/privacy-and-security/privacy/subprocessors.
Please contact Us using the details below in Part 15 for further information about the particular data protection safeguards used by Us when transferring your personal data to a third country.
The security of your personal data is essential to Us, and to protect your data, We take a number of important measures, including the following:
limiting access to your personal data to those employees, agents, contractors, and other third parties with a legitimate need to know and ensuring that they are subject to duties of confidentiality;
procedures for dealing with data breaches (the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, your personal data) including notifying you and/or the Information Commissioner’s Office where We are legally required to do so;
10 Do You Share My Personal Data
Our Site is hosted on Shopify. We share identity, contact, order, payment, device and usage information with Shopify to operate Our online store, process purchases and support customers. Shopify generally processes this information on Our behalf. For certain services, including the Enhanced Services provided through Shopify Network Intelligence, Shopify also acts as a separate controller.
Shopify Network Intelligence is enabled for Our store. Shopify uses information about your interactions with Our Site, other merchants and Shopify to provide and improve services, including analytics, personalisation and advertising. This may involve sharing information with Shopify and other service providers in other countries. Where required, these activities depend on your consent, which you can withdraw through Our cookie preferences. For details of Shopify’s processing and your rights, see Shopify’s Consumer Privacy Policy at https://www.shopify.com/legal/privacy/consumers and its privacy portal at https://privacy.shopify.com/en.
We also use service providers to support payment processing, order collection scheduling, forms and communications. These include Shopify Payments and Shopify tools such as Forms, Messaging and Search & Discovery; Pickeasy for pickup or delivery scheduling; and CWILL/SendWILL for subscription forms and related email-marketing functions. Providers receive the information needed for the services they perform. Relevant provider notices include https://www.cwill.com/privacy-policy/.
Where necessary for the business purposes described in this Policy, We may share relevant personal data with other companies in Our group in the UK or internationally, subject to applicable safeguards.
Where a provider acts as Our processor, We require it to handle personal data under appropriate contractual terms and security obligations. Where a provider acts as a separate controller, its own privacy notice also applies. Transfers outside the UK are addressed in Part 9.
If We sell, transfer, or merge parts of Our business or assets, your personal data may be transferred to a third party. Any new owner of Our business may continue to use your personal data in the same ways that We have used it, as specified in this Privacy Policy.
In some limited circumstances, We may be legally required to share certain personal data, which might include yours, if We are involved in legal proceedings or complying with legal obligations, a court order, or the instructions of a government authority.
11 How Can I Control My Personal Data
In addition to your rights under the Data Protection Legislation, set out in Part 5, when you submit personal data via Our Site, you may be given options to restrict Our use of your personal data. In particular, We aim to give you strong controls on Our use of your data for direct marketing purposes (including the ability to opt-out of receiving emails from Us which you may do by unsubscribing using the links provided in Our emails).
You may also wish to sign up to one or more of the preference services operating in the UK: The Telephone Preference Service (“the TPS”), the Corporate Telephone Preference Service (“the CTPS”), and the Mailing Preference Service (“the MPS”). These may help to prevent you receiving unsolicited marketing. Please note, however, that these services will not prevent you from receiving marketing communications that you have consented to receiving.
12 Can I Withhold Information
You may access certain areas of Our Site without providing any personal data at all. However, to use all features and functions available on Our Site you may be required to submit or allow for the collection of certain data.
You may restrict Our use of optional Cookies. For more information, see Part 14 and Our Cookie Policy at https://www.cafenicolasrouzaud.com/pages/cookie-policy.
13 How Can I Access My Personal Data
If you want to know what personal data We have about you, you can ask Us for details of that personal data and for a copy of it (where any such personal data is held). This is known as a “subject access request”.
You may make a subject access request verbally or in writing. To help Us respond, you can use the email or postal address in Part 15. We may request information reasonably necessary to verify your identity.
There is not normally any charge for a subject access request. If your request is ‘manifestly unfounded or excessive’ (for example, if you make repetitive requests) a fee may be charged to cover Our administrative costs in responding.
We will respond without undue delay and normally within one month, subject to any adjustments permitted by law, for example where identity verification or necessary clarification is required. Where a request is complex or you have made several requests, We may extend the response period by up to two further months. We will tell you about an extension and the reasons within the applicable initial response period.
14 How Do You Use Cookies
Our Site uses Cookies and similar technologies provided by Shopify and, where applicable, the other service providers described in Our Cookie Policy. These technologies may collect online identifiers and information about your device and use of Our Site.
Strictly necessary Cookies support services you request, such as the shopping basket, checkout, security and remembering your privacy choices. We do not seek consent for these Cookies. We ask for your consent before using optional analytics, personalisation or advertising Cookies and similar technologies. You can accept, decline or choose categories in Our cookie banner. Continuing to browse does not constitute consent. Refusing optional Cookies does not prevent you from browsing or placing an order.
You can change or withdraw your consent at any time using the Cookie preferences control on Our Site. Your choices apply to the browser and device you are using, so you may need to set them again on another browser or device, or after clearing Cookies. Withdrawing consent does not affect the lawfulness of processing before withdrawal.
The names, purposes and durations of the Shopify Cookies relevant to Our store, together with information about other providers, are set out in Our Cookie Policy at https://www.cafenicolasrouzaud.com/pages/cookie-policy. We maintain that separate policy as the detailed reference for Cookies to avoid inconsistent lists across these documents.
